Booking conditions
These Terms and Conditions govern the relationship between you, the Client or Agent, and us, INDOCHINA CHARM INTERNATIONAL TRAVEL JOINT-STOCK COMPANY (“INDOCHINA CHARM TRAVEL”). By booking a tour at INDOCHINA CHARM TRAVEL, you have agreed to be bound by these Terms and Conditions. They outline, among other things, our cancellation policy, certain limitations of liability and disclaimer. These terms affect your rights to sue, governing law, forum, and jurisdiction; please be sure to carefully read these terms and make sure you understand your rights and obligations and our rights and obligations.

 

Price
All prices quoted to Client/Agent are on a net basis and in United States Dollars (“USD” or “US$”) and valid according to the date specified on the INDOCHINA CHARM TRAVEL printed quotation and/or invoice issued to the Client/Agent. INDOCHINA CHARM TRAVEL guarantees that the prices or rates quoted to the Client/Agent are correct at the time of issuance of the Client’s/Agent’s quotation and/or invoice but are subject to change in accordance with market, tax or exchange rate fluctuation, with or without prior notice.

 

Reservation and confirmation
Reservations can be made to INDOCHINA CHARM TRAVEL office via website or email or fax. Upon confirmation of a reservation:

 

• 30% (thirty percent) deposit is required to secure your reservation
• remaining balanced amount of 70% (seventy percent) must be fully received by INDOCHINA CHARM TRAVEL at least 15 (fifteen) days  prior to client's arrival in the destination country or starting date of the tour.

 

If the final payment is not received by the due date, Client’s/Agent’s reservation will be cancelled and the Clients/Agents will have to pay the cancellation charges. INDOCHINA CHARM TRAVEL also reserves the right to correct any arrangement (including tours, programs, prices and services) in the best interest of its Client/Agent, with or without prior notice.

 

Payment

1. Payment by swift/telegraphic transfer:
Except otherwise accepted by INDOCHINA CHARM TRAVEL, Client’s/Agent’s payment shall be executed by swift or telegraphic transfer to the appropriate INDOCHINA CHARM TRAVEL bank account. Any bank charges levied by the sending banks (and mediate banks) relating to transfers to INDOCHINA CHARM TRAVEL must be paid by Client/Agent.

Note: After your payment telegraphic transfer is done, please fax the receipt of the payment provided by the bank to us at: (844) 3927 5183 , or scan the receipt and email it to us.

 

2. By credit card:
Client's/Agent’s payment can be also executed by credit cards. The procedure require Client/Agent to fill out the payment guarantee form/credit card authorization form provided by us, and then fax or email the scanned form to us. By this time, only  Visa card and Master card are accepted.

 

Note:
• Credit cards are only used for settling deposit.
• 3% banking fee shall be applied to any and every settled amount (by Vietcombank).

 

3. Payment via Xoom.com or by Western Union:
We accept the payment via www.xoom.com or by Western Union in urgent case.

 

4. Payment by cash:
Payment by cash on spot is applied for any extra services after settling full payment for main tour booking.

 

Vouchers
Vouchers for booking arrangements and copy of Client’s’/Agent’s itinerary shall be issued to Client ‘Agent on arrival by a representative from INDOCHINA CHARM TRAVEL.

 

Cancellation and refund
Should Client/Agent cancel your trip must notify INDOCHINA CHARM TRAVEL in writing. Under such circumstance, Client/Agent shall be subject to pay cancellation charge. The cancellation charges will be a certain percentage of the tour price as follows:

 

FIT bookings (1 - 10 passengers)
• More than 45 days before departure: $250 (for administrative fee)
• From 45 to 30 days: 25% of total tour price
• From 30 to 15 days: 50% of total tour price
• From 15 to 7 days: 75% of total tour price
• Less than 7 days or no show: 100% of total tour price

 

GIT bookings (11 passengers and up): INDOCHINA CHARM TRAVEL will inform for each booking and it depends mostly on suppliers policy.

 

After the tour begins, any extra charges caused by Client’s/Agent’s changes will be paid by Client/Agent. Any unused portion is neither refundable nor exchangeable.

 

INDOCHINA CHARM TRAVEL calculate your refund on the day when we receive the written cancellation by Vietnam time. All refunds to the client will be processed within 30 days of receipt of your cancellation. The service charge of the refund is USD50.00 per time.

 

Responsibilities
We, INDOCHINA CHARM TRAVEL, commit to do our best to meet the Client’s/Agent’s satisfaction. However, it is the understanding of the Parties that as a tour operator, INDOCHINA CHARM TRAVEL acts as an intermediary between the Client/Agent and various suppliers, including airlines, hotels, transportation operators, local tourist offices and other contractors providing the services to the Client/Agent. INDOCHINA CHARM TRAVEL does not own or operate any of these Suppliers. As such, INDOCHINA CHARM TRAVEL is not liable to the Client/Agent by unsatisfactory services or failure to act of any suppliers or any third party. By utilizing the travel services of the suppliers, you, the Client/Agent, agree that you will look to such Suppliers for any accident, injury, property damage, delay, change in schedule, or personal loss to you or to those traveling with you, and that neither INDOCHINA CHARM TRAVEL nor its representative shall be responsible.

 

The Client/Agent also warrants that INDOCHINA CHARM TRAVEL shall not be responsible and/or liable for any injury, loss, or damage to person or property, death, delay, or inconvenience incurred due to acts of God or force majored, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes of other means of transportation or for the failure of any transportation mechanism to arrive or depart on time, sanitation problems, lack of medical care, or for any other cause beyond the control of INDOCHINA CHARM TRAVEL.

 

INDOCHINA CHARM TRAVEL reserves the right to correct promotional or pricing errors at any time, or to increase the program price in the event of cost increases due to changes in airfares, cruise fares, currency fluctuations, taxes, or fuel surcharges.

 

Health Requirements
It is the Client’s/Agent’s responsibility to avail themselves with information regarding health requirement, medical and health insurance for the duration of their trip to the destination country.

 

Claims
All disputes, claims and litigation regarding the Services shall first be settled by way of negotiation and mutual understanding. In the event such negotiation and mutual understanding would fail, the disputes, claim or litigation shall be finally settled by local arbitration in Vietnam. All claims must be submitted in writing within 30 days after the end of the Services.
